We also want to make sure that you are aware of the options available to you when you access and use our Services.

1.   THE PERSONAL DATA WE COLLECT AND PROCESS:

We collect contact information, technical data, profile data, communication data, content, and other data received from you. We use this personal data to provide, improve and secure our Service; for analytics, marketing and sales purposes; to comply with applicable laws; and to support our legitimate interests.

We collect various types of data regarding our users as well as data regarding visitors to our Site ("Visitors").   • We need to know this information so that we can process any orders for Services that you make on our Site, send you email confirmations of your order, and verify your payment details (contractual performance).

Social Media Profile information, when you sign up via Facebook or Google+: data from your public profile, including your name, profile photo, email address, nationality and other information is provided to us by Facebook or Google+ (contractual performance; legitimate interests; legal obligations; consent): We need to know these to register you as a user, secure your account and to enable you to log into your account in the future (contractual performance).

  • Le Choix Gagnant associates the email address provided by the social media provider with your account so that you can use your email address to sign in to your account in the future if you no longer wish to sign in using your social media account credentials.
  • If you do not want your information to be shared with us by the social media provider, then you can simply sign in to your Le Choix Gagnant account using your account credentials instead of your social media account credentials.

Your (mobile) telephone number

  • We ask for your phone number so that we can contact you in case we need to. (contractual performance)

Your payment details (contractual performance, legitimate interests)

  • For online payments and other transactions, we use a third party payment service provider e.g. Recurly, Stripe Payments Europe Ltd., Paypal (each, "PSP"). We do not ourselves access any payment details from users of the Services. Processing of any of your personal data by the PSP is covered by the PSP’s respective privacy policy.

  • With your consent, our customer support representatives may sign in to your account, if appropriate, to help troubleshoot and resolve your issue (consent).

We use a tool called “Google Analytics”, provided by Google and used by us to track and analyze the use of our Services for internal purposes. (b) information about your visit, including the full Uniform Resource Locators (URL) clickstream to, through and from our site (including date and time); products you viewed or searched for, the frequency and scope of your use of the Services, page interaction information (such as scrolling, clicks, and mouse-overs), the content you viewed (including advertisements you clicked on) and pages you visited, your communications with vendors, other users and third parties, and cookie data.

We may also use tracking pixels in our email newsletter enabling us to see if and when an email was opened and if certain links in that email were clicked by the addressee (consent). e.   Anonymized or aggregated data

We may collect, use, and share anonymized or aggregated data such as statistical or demographic data for any purpose. Anonymized or aggregated data may be derived from your personal data but is not considered personal data, as this data does not relate to an identified or identifiable person. For example, we may aggregate your usage data to calculate the percentage of users accessing a specific website feature. We may use anonymized or aggregated data indefinitely without further notice to you.

f.   If you fail to provide Personal Data

Where we need to collect personal data by law, or under the terms of a contract we have with you and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you (for example, to provide you with goods or services). In this case, we may have to cancel a product or service you have with us, but we will notify you if this is the case at the time.

Le Choix Gagnant limits access to your personal information by Le Choix Gagnantpersonnel to those whom we believe reasonably need that information to provide products or services to you or in order to do their jobs.

g.   Change of Purpose

We will only use your Personal Data for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose.

We share your data with our affiliates; with our service providers and advisors; and in accordance with legal compliance.

We value your privacy and will not share your personal information except with the parties set out below for the purposes indicated in Section 1 above. We make sure they adhere to the same standards of data protection that we do.

This relates to companies that are legally part of the same group of companies that we are part of, or that become part of that group. Currently our affiliates are based in the USA and provide IT and system administration services.
  • Service providers based in the USA who provide IT and system administration services.
  • Professional advisers including lawyers, bankers, auditors and insurers based in the USA who provide consultancy, banking, legal, insurance and accounting services.
  • We may use and share with third parties the information we collect from and receive about you in order to deliver content or advertising; to perform market research or measure website usage; and to analyze traffic counts, your interests and website performance.
  • We may disclose Personal Information (i) as a response to a legal request (such as a court order, search warrant, or subpoena) if we believe that we are required to do so by applicable law; or (ii) when we believe that such disclosure or use is necessary in order to: reveal, prevent and address fraud, intellectual property infringement, piracy, or other illegal activities; enforce this Policy or our Terms of Use, including in order to investigate potential breaches; protect our rights, property or safety, or those of our users or from members of the public from harm, as required or permitted by law; and prevent death or imminent bodily harm.   • Third parties to whom we may choose to sell, transfer, or merge parts of our business or our assets. Alternatively, we may seek to acquire other businesses or merge with them. If a change happens to our business, then the new owners may use your personal data in the same way as set out in this Policy. If we believe that such change in control might materially affect your Personal Data then stored with us, we will notify you of this event and the choices you may have via e-mail or prominent notice on our Services.

We require all third parties to respect the security of your personal data and to treat it in accordance with the law. We do not allow our third-party service providers to use your personal data for their own purposes and only permit them to process your personal data for specified purposes and in accordance with our instructions.

Non-Personally Identifiable Information.

  • We may also share aggregated or non-personally identifiable information that we collect under any of the above circumstances with our business partners, affiliates or other third parties to develop and deliver targeted advertising on our websites and on websites of third parties. We may also share aggregated information with third parties, including advisors, advertisers and investors, for the purpose of conducting general business analysis. 3.   COOKIES AND OUR COLLABORATION WITH THIRD-PARTY AD NETWORKS

We and our service providers use cookies and other technologies for performance, tracking, analytics and personalization purposes.

Our Site, Services and some of our service providers utilize "cookies", anonymous identifiers and other tracking technologies which help us provide, secure and improve our Services, personalize your experience and monitor the performance of our activities and campaigns.   • Hotjar Cookie

    We use Hotjar in order to better understand our users' needs and to optimize this service and experience. Hotjar is a technology service that helps us better understand our users' experience (e.g. how much time they spend on which pages, which links they choose to click, what users do and don't like, etc.) and this enables us to build and maintain our service with user feedback. Hotjar uses cookies and other technologies to collect data on our users' behavior and their devices. This includes a device's IP address (processed during your session and stored in a de-identified form), device screen size, device type (unique device identifiers), browser information, geographic location (country only), and the preferred language used to display our website. Hotjar stores this information on our behalf in a pseudonymized user profile. Hotjar is contractually forbidden to sell any of the data collected on our behalf.   • Mixpanel Cookie

    Our websites use cookies from Mixpanel to register your type of browser as well as your operating system, language preferences and IP address and to send these data to a Mixpanel server. We only receive your IP address in anonymized form from Mixpanel so that you can be assured that your privacy is always protected. Moreover, via the Mixpanel platform an analysis is made of all data registered during the use of our offers. In this way, we can continuously improve our offers to you.   • Facebook Pixel

    Our websites use Facebook Pixel provided by Facebook Inc. (“Facebook”) If you are redirected to our websites via an ad on Facebook or via Facebook Messenger, Facebook will set a cookie on your computer. This conversion-tracking cookie will be set when a user clicks an ad on Facebook. Such cookies expire after 28 days and cannot be used to identify you personally. If a user visits certain pages on our website before the cookie has expired, we and Facebook can see that the user clicked the ad and was redirected to this page. Each individual Facebook customer receives a different cookie, and therefore cookies cannot be tracked via the websites of Facebook customers. The data collected by way of conversion cookies are used to make conversion statistics for Facebook customers who have decided to use conversion tracking. The customers will receive information about the total number of users who have clicked their ad and been redirected to a page with a conversion-tracking tag. However, they will not receive any information that may be used to identify specific users.

    If you do not want this tracking to take place, you can disable the installation of the cookie that is necessary for the tracking - for example in your browser settings where you can either deactivate the automatic cookie function or disable cookies from the “facebook.com” domain in your browser.

Google Ads and Other Advertising Networks

We collaborate with Google and other advertising networks as business partners. These third party networks use cookies to serve ads it displays on our Site and on other websites of its partners, based on a user's prior visits to our Site or other websites. Unless expressly stated otherwise, our website does not provide personal information to these third parties. This information allows them to deliver targeted advertisements and gauge their effectiveness. 4.   COMMUNICATIONS

We engage in service and promotional communications, through email, phone, SMS and notifications.

Service Communications: We may contact you with important information regarding our Service. For example, we may send you notifications (through any of the means available to us) of changes or updates to our Service, billing issues, service changes, log-in attempts or password reset notices, etc. You can control your communications and notifications settings from your Account settings. However, please note that you will not be able to opt-out of receiving certain service communications which are integral to your use (like password resets or billing notices).

Promotional Communications: We may also notify you about new features, additional offerings, events and special opportunities or any other information we think our users will find valuable. We may provide such notices through any of the contact means available to us (e.g. phone, mobile or email), through the Service, or through our marketing campaigns on any other sites or platforms.

5.   TRANSFERS OF PERSONAL DATA

We store your data in the United States.

7.   HOW DO WE SECURE YOUR INFORMATION?

We secure your Personal Data using industry-standard administrative, technical, and physical measures.

We consider data security a top priority and we do our best to keep your Personal Data secure. We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorized way, altered or disclosed. Such measures include:

  • Encrypting many of our services using SSL.
  • Employing firewalls and intrusion detection systems.
  • Practicing administrative, technical, and physical security procedures to help protect the information you provide us.

8.   PROTECTION OF CHILDREN'S PRIVACY

Our Service is not directed towards children under the age of 18.

Our Services are not directed to children under eighteen (18) years. We do not knowingly collect Personal Data from children and do not wish to do so.

9.   RIGHTS TO ACCESS PERSONAL DATA

You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we may refuse to comply with your request in these circumstances

We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.

We try to respond to all legitimate requests within one month. Occasionally it may take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.

11.   RIGHTS OF CALIFORNIA RESIDENTS

California residents have the right to request that Le Choix Gagnant (i) provide you with access to the Personal Information that we hold about you, (ii) correct your Personal Information, (iii) delete your Personal Data, and (iv) cease or restrict disclosures or sales of your Personal Data to third parties.
